Payment Terms & Conditions
These terms apply to all orders placed with Lave Studio. By placing an order, the customer agrees to be bound by these terms.
1. Payment Schedule
Payment terms are determined by the total net order value, as set out below.
Orders under £5,000
Full payment (100%) is required at the time of placing the order, before production commences. No work will begin until cleared funds are received.
Orders of £5,000 or more
A staged payment structure applies. A 50% deposit is due when placing the order, before production begins. The remaining 50% balance is due upon completion of production and before dispatch.
2. Quotations & Order Confirmation
- All quotes are valid for 30 days from the date of issue.
- A quote does not constitute acceptance of an order. Production will only commence upon receipt of a signed order confirmation and cleared deposit payment.
- Lead times are calculated from the date of final written approval of specifications — not from the date of deposit.
- Any changes to specification after order confirmation may affect price and lead time, and will require a revised quote.
3. Retention of Title
Ownership of all goods remains with Lave Studio until full payment has been received and cleared. Until such time:
- The customer holds the goods as bailee on behalf of Lave Studio.
- Lave Studio reserves the right to repossess the goods if payment is not made in full.
- The customer must not sell, assign, or encumber the goods until full payment is received.
Goods will only be dispatched once the full balance has been received and cleared. No exceptions will be made without prior written agreement from Lave Studio.
4. Late Payment
We understand that delays can happen. If payment is not received within 7 days of the due date, Lave Studio reserves the right to:
- Suspend production or withhold dispatch of goods.
- Charge statutory interest on the overdue amount at 8% above the Bank of England base rate, accruing daily from the date 7 days after the due date — in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
- Charge a fixed compensation fee as set out under the Late Payment of Commercial Debts Regulations 2002: £40 for invoices under £1,000; £70 for invoices £1,000–£10,000; £100 for invoices over £10,000.
- Recover reasonable debt recovery costs in addition to the above.
If the balance payment remains outstanding for more than 30 days after the due date, Lave Studio reserves the right to resell or otherwise dispose of the completed goods to a third party. In such circumstances, Lave Studio will apply the proceeds against the outstanding balance and pursue the customer for any remaining shortfall, together with all accrued interest, compensation fees, and reasonable costs of recovery. The deposit will not be refunded.
Time of payment is of the essence of the contract.
5. Cancellations
As all goods are made to order, the following cancellation charges apply:
| Cancellation Timing | Charge |
|---|---|
| Before production has commenced | Deposit forfeited; no further charge |
| Once production has commenced | 50% of total order value (full deposit retained) |
| Once production is complete | 100% of total order value payable in full |
6. Pricing
- Lave Studio is not currently VAT registered. All prices are quoted and invoiced without VAT.
- Quoted prices are valid for 30 days. After this period, Lave Studio reserves the right to requote.
- Delivery and packaging are included in the total price. Installation is not included unless explicitly stated in the quote.
7. Disputes
Any disputes relating to the quality or specification of goods must be raised in writing within 7 days of delivery. Lave Studio will not accept liability for issues raised after this period.
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
